South Dakota Law Protects Property Rights
Since 1889, the South Dakota Constitution has protected the property rights of its citizens.
Section 1 of the South Dakota Bill of Rights expressly provides that all men and women have certain
inherent rights, among which are those of enjoying and defending life and liberty,
of acquiring and protecting property, and the pursuit of happiness.
Section 2 provides that
No person shall be deprived of life, liberty or property without due process of law.
Section 20 provides that all courts shall be open, and every person for an injury done
in property, person or reputation, shall have remedy by due course of law, and right and justice, administered without denial or delay.
And as early as 1892, the South Dakota Supreme Court described these constitutional property rights as “not mere ‘glittering generalities,'” but as “sacred guaranties to the citizen.”
