Litigation Against Oil And Gas Companies For Property Damage Claims

In South Dakota and Wyoming, much of the population owes their livelihood to the land. Sometimes, oil and gas companies disregard the property rights of ranch families in West River.

The lawyers at Barker Wilson Law Firm have decades of experience representing landowner interests in disputes with oil and gas companies and other parties that are involved in industrial and workplace accidents. We have sued large corporations on grounds of trespass, breach of contract and fraud when our clients have been wronged.

We Trust South Dakota Juries

The threat of a lawsuit seldom affects the executives at oil and gas companies who would violate property rights of ranchers. But a trial date with a jury can have a very different effect. We prepare every case as if it were going to trial. We know that South Dakota juries will protect the rights of property holders and hold accountable those who violate property rights of others. Those executives know it, too, or they find out.

South Dakota Law Protects Property Rights

Since 1889, the South Dakota Constitution has protected the property rights of its citizens.

Section 1 of the South Dakota Bill of Rights expressly provides that all men and women have certain inherent rights, among which are those of enjoying and defending life and liberty, of acquiring and protecting property, and the pursuit of happiness.

Section 2 provides that no person shall be deprived of life, liberty or property without due process of law.

Section 20 provides that all courts shall be open, and every person for an injury done in property, person or reputation, shall have remedy by due course of law, and right and justice, administered without denial or delay.

And as early as 1892, the South Dakota Supreme Court described these constitutional property rights as "not mere 'glittering generalities,'" but as "sacred guaranties to the citizen."
